Catalogue of Commodities subject to the Administration of Export Licences

The Ministry of Commerce and the General Administration of Customs issued the catalogue on December 30, 2022, set to take effect from January 1, 2023. This catalogue has been revised in accordance with laws and regulations, including the Foreign Trade Law, Regulation on the Import and Export of Goods, Methods for the Management of Export License, etc. The objective is to clearly define the list of goods subject to export licence control.
The catalogue serves three primary functions: (1) It lists 43 goods that require an export licence; (2) It identifies goods eligible for multiple clearances under a single licence, up to a limit of 12; (3) It names the institutions authorised to issue export licences.
Critical minerals mentioned in the catalogue include: phosphorite, magnesium sand, rare earths, tin and tin products, tungsten and tungsten products, antimony and antimony products, and germanium.
Export licences are still a necessity for most rare earth exports. Specifically, cerium and cerium alloys (with particles <500 microns) tungsten and tungsten alloys (particles <500 microns), zirconium and beryllium need a distinct export licence for dual-use items and technology. Furthermore, the suspension of designated port management for items such as magnesite, rare earths, antimony, and antimony products remains in effect.
