Carbon Claims Guide for Businesses

In November 2011, the Australian Competition and Consumer Commission published Carbon price claims - Guide for Business. The aim of the Guide was to provide businesses with guidance and information about their rights and obligations under the Competition and Consumer Act 2010 in the lead up to the commencement of the carbon price on 1 July 2012. The Guide sets out a range of guidance and information for businesses in relation to claims or represenations about the impact of the carbon price, including the ACCC's role, problematic carbon price claims and information to support claims, along with checklists and examples. The Guide also addresses carbon price calculators, talking with your competitors, recommended prices, advise from industry associations, and dealing with your agents. Guidance is also provided on the ACCC's compliance and enforcement approach, and the type of action the ACCC can take if a business makes a false, misleading or deceptive claim.
